1. These terms apply to all deliveries and services of Amann Trading & Consulting GmbH (\u201cAmann Trading\u201d) to entrepreneurs within the meaning of \u00a714 BGB.
2. Contracts with consumers are excluded.
3. Conflicting terms of the buyer shall not apply unless expressly accepted in writing.<\/p>\n

\u00a72 Offers and Contract Formation
1. Offers are non\u2011binding.
2. A contract is concluded only upon written confirmation or delivery.
3. Technical descriptions or illustrations are non\u2011binding.<\/p>\n

\u00a73 Prices
1. Prices are those stated in the order confirmation.
2. Prices are ex warehouse Berlin plus shipping and applicable taxes.
3. Export duties and import taxes are borne by the buyer.

\u00a74 Delivery
1. Delivery dates are non\u2011binding unless agreed otherwise in writing.
2. Deliveries are subject to correct and timely supply by our suppliers.
3. Partial deliveries are permitted.
4. Force majeure entitles Amann Trading to extend delivery time or withdraw.<\/p>\n

\u00a75 Shipping and Transfer of Risk
1. Shipping is at the buyer\u2019s risk.
2. Risk transfers once goods are handed to the carrier or freight forwarder.
3. This also applies if shipping costs are paid by Amann Trading.<\/p>\n

\u00a76 Transport Damage
Transport damage must be reported to the carrier immediately upon delivery.<\/p>\n

\u00a77 Inspection and Notice of Defects
1. Goods must be inspected immediately after delivery.
2. Visible defects must be reported within 5 working days.
3. Hidden defects must be reported immediately after discovery.<\/p>\n

\u00a78 Warranty
1. Warranty period is 12 months from transfer of risk.
2. Remedy will be repair or replacement at Amann Trading\u2019s discretion.
3. If remedy fails twice, buyer may reduce price or withdraw.<\/p>\n

\u00a79 Returns
Returns require prior written authorization (RMA).<\/p>\n

\u00a710 Retention of Title
Goods remain property of Amann Trading until all claims are paid.<\/p>\n

\u00a711 Payment
Invoices are payable immediately unless agreed otherwise.<\/p>\n

\u00a712 Liability
1. Liability only for intent or gross negligence.
2. Limited liability for essential contractual obligations.
3. No liability for indirect damages, loss of profit or consequential damages.<\/p>\n

\u00a713 Export Regulations
Buyer must comply with all applicable export and sanctions regulations.<\/p>\n

\u00a714 Data Protection
Personal data is processed according to GDPR.<\/p>\n
